1. Introduction

2. Pricing

All prices are non-binding and are valid until revoked.

All prices are stated in euros and including statutory value added tax of 13 % or are in accordance with the special arrangements for the taxation of the margin.

Shipping costs and, if applicable, import duties and taxes are to be borne by the buyer.

In case of shipment to costumers outside the European Economic Area (EEA) or companies within the EU with a valid UID number, the value-added tax does not apply as long as the artwork is not in accordance with the special arrangements for the taxation of the margin.

Where an inadvertent error arises in any stated price we reserve the right to correct such and will offer you the opportunity to cancel your order or proceed at the correct price.

3. Delivery or collection

Shipping costs are to be borne by the buyer.

3.1. Shipping costs

Shipping costs depend on the measurements and the weight of the package and as well on the commissioned transport company. Please take note of the detailed price breakdown at the order information.

3.2. Delivery Period

Processing may take up to 14 days after orders have been placed within our web shop. Delivery takes place via mail or by another transport company (FedEx, or the like) and may take up to 10 days within Europe. Overseas delivery may take up to 14 days. In some cases delivery might be delayed.

3.3. Transport insurance

Depending on the transport company the shipment of the artworks is covered up to a certain amount. If you require an additional insurance, please contact us to add the additional costs to the invoice amount. Insurances may vary for international shipments.

4. Payment

We accept advance payment or payment via PayPal. The invoice amount is due for payment immediately without any discounts.

Goods will be shipped after full payment has been received on our bank or PayPal account.

5. Retention of Ownership

Kunsthandel Widder GmbH retains ownership of the goods until full payment has been received.

6. Conclusion of Contract

The presentation of goods in our online shop is a non-binding request on our part to order artworks. By clicking “Order” you are sending a binding offer at the stated price. Subsequently, you will receive an automated order confirmation via e-mail which confirms the reception of the order. This e-mail does not constitute conclusion of a contract. As we are using various channels (gallery, art fair, telephone, internet) to sell artworks and we are not always able to update our webshop-offer immediately, it is possible that an artwork, which is not available anymore, can still be selected at the webshop. For this reason the contract will only be concluded if the Kunsthandel Widder GmbH explicitly accept your offer. After your offer has been accepted you will receive an e-mail in a timely manner. If the artwork has already been sold, you will certainly be informed by e-mail.
Because of frequent exhibitions at art fairs and other events, it could occur, that recently sold artworks are not immediately deleted online. If an artwork is already sold, you certainly will be informed as soon as possible that we are not able to proceed your order.

7. Warranty

The guarantee is amenable to the statuary provisions of Austria. Kunsthandel Widder GmbH guarantees the authenticity of the artworks.

8. Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without stating any reason.

The withdrawal period is 14 days from the date the contract is concluded.

making a clear statement (e.g. by letter sent by post, fax or e-mail) of your decision to withdraw from the contract.

Consequences of Withdrawal

If you withdraw from this contract, we will refund all payments we received from you, including delivery costs (except for additional costs arising if you chose a method of shipping different from the most cost-efficient standard delivery offered by us), without delay and at the latest within fourteen days from the day on which we received the notice of withdrawal from this contract. The repayment will be made using the same payment method as used for the original transaction, unless otherwise explicitly agreed with you; under no circumstances will you be charged fees for this repayment.

9. Place of performance and place of jurisdiction

The place of performance in respect of all services and obligations under the contract is Vienna.
The agreed place of jurisdiction arising in connection with this contractual relationship shall be the district court of 1010 Vienna.

10. Privacy and Data Security

All data collected during the use of our services will be exclusively used by Kunsthandel Widder GmbH. The costumer agrees that his personal data listed in the contract will be collected, stored and processed for the purpose of the accounting and the costumer documentation. The data will be processed to fulfill governmental regulations and processing payment flows. Customer data is not passed on third, unless if this is necessary for the fulfillment of the contract (shipping companies, insurance). By using our services you agree to the use of your data for marketing and informational purposes.

11. General Information

Please keep in mind that some art works might look differently on your device’s screen. You can ask for further photos and information about art works at any time.
